The KS Ignition Interlock Program
The legal BAC (blood alcohol content) limit in Kansas is .08 percent, and offenders driving while at or above that BAC risk a DUI conviction. They may be required to pay fines, their license will be revoked, and they may be ordered to attend treatment. Some offenders may be able to regain their driving privileges if they install an ignition interlock device.
Per KS ignition interlock law, offenders must install an IID from a provider the state approves. Intoxalock is an approved provider in Kansas. In order to regain driving privileges, offenders will have to show proof of installation.
What Happens if I Get a DUI in Kansas?
First DUI Offense
- 48 hours to six months in prison or 100 hours of community service
- Must complete court-ordered alcohol and safety education or treatment program
- Fine of $750-$1,000 plus court costs, probation, and evaluation fees
- License suspended for 30 days, then restricted for 180 additional days
- Interlock device required to restore driving privileges
Second DUI Offense
- 90 days to one year in prison
- Must complete court-ordered alcohol and safety education or treatment program
- $1,250 to $1,750 fine plus court costs, probation, and evaluation fees
- One-year license suspension, followed by one year of a restricted license
- IID required to restore driving privileges
Third DUI Offense
- Offense is upgraded to felony from misdemeanor
- 90 days to one year in jail
- Must complete court-ordered alcohol and safety education or treatment program
- $1,750 to $2,500 fine plus court costs, probation, and evaluation fees
- License suspended for one year, followed by two years of a restricted license
- IID required to restore driving privileges
What Happens if I Fail to Complete or Refuse to Submit to a DUI Test in Kansas?
Drivers who are suspected of DUI have the right to refuse a blood, urine, or breath test. However, this does not protect them from potential consequences. If you refuse a test, your driver’s license can be suspended for up to one year.
Restricted Driving Privilege in Kansas?
Kansas allows qualified offenders to receive a restricted driver’s license if they install an ignition interlock. They may need to meet these additional criteria.
- Wait the required portion of the mandated suspension period
- Fill out the Kansas Ignition Interlock Installation/Removal Verification Form
- Fulfill all penalty requirements including fines
- Install an ignition interlock device from an approved provider
- If required, show proof of SR-22 insurance
- Pay license reinstatement fee
How Do I Get a Limited Driving Privilege in Kansas?
Repeat offenders are not eligible for the Restricted Driving Privilege option, but in some cases, they may apply for a Limited Driving Privilege. Sometimes this is referred to as a hardship license. There is no option for a limited commercial driver’s license. To qualify, offenders must either submit an application to the Department of Revenue or petition the court.
Offenders who qualify can submit an application to the Department of Revenue, and they may also need to:
- Complete the Application for Limited Driving Privilege Form
- If necessary, obtain and show proof of SR-22 insurance coverage
- If there is more than one offense or their license is currently revoked, offenders must provide proof of IID installation
- Must keep IID installed during the entire time they have the LDP
Other things the offender may do to qualify, include:
- Pay a filing fee and court costs associated with the petition
- Pay any legal fees if necessary
- Submit a form proving SR-22 insurance coverage if required
- If there are multiple alcohol offenses or an active Chemical Revocation on the driver’s record, they must submit proof that an IID has been installed in any vehicle the offender operates.
If the court approves the petition, the offender will receive an Order Granting Limited Driving Privilege.
