Understanding Utah's House Bill 69

In the ongoing battle to curb the dangers of driving under the influence (DUI), Utah has taken a bold step forward with House Bill 69 (HB 69), specifically targeting repeat DUI offenders. This legislation, which goes into effect on 5/1/2024, introduces new measures aimed at reducing recidivism rates and enhancing road safety.

The Challenge of Repeat DUI Offenders

Repeat DUI offenses pose a significant challenge to public safety, with individuals convicted of multiple DUIs accounting for a disproportionate number of alcohol-related accidents and fatalities on the roads. HB 69 provides 2nd and subsequent offenders the option to install an ignition interlock device (IID) during the time between their administrative suspension and conviction to help.

The Provisions of House Bill 69

If the Utah Driver License Division suspends an offender’s license for a 2nd or subsequent offense occurring within 10 years of an offender’s first DUI offense, the offender can petition the Driver License Division to become an ignition interlock restricted driver.

A person in this situation who petitions to become an ignition interlock restricted driver must:

  • Be currently charged with misdemeanor DUI
  • Has no other driving privilege restrictions outside of the DUI charge
  • Installs an IID in any vehicle owned or driven by the person
  • Has paid any outstanding driver license reinstatement application fees

Any person that fits these criteria shall maintain the IID restriction for at least two years.

If a person removes their IID prior to the two-year period expiring without installing a new device (from the same or different provider) within 24 hours they are subject to:

  • A full license/driving privilege suspension for the remainder of the IID restriction period
  • They are unable to subsequently decide to reinstall an IID

If the underlying criminal DUI charge for which the Utah Driver License Division has suspended a person’s license is dismissed, the person is able to remove the ignition interlock device without any penalties if the Utah Driver License Division receives written verification of the person’s dismissal of charges against the person prior to the removal of the IID.
