Intoxalock Asks An Attorney - Craig Rosenstein of Rosenstein Law

The Intoxalock Ask an Attorney series talks with attorneys across the nation to find out what changes are happening in the legal industry and how they are helping clients in new ways.

Most recently, these interviews have been focused on how defense attorneys are assisting clients as they navigate the DUI process during the time of COVID-19. This edition features an interview with attorney Craig Rosenstein of Rosenstein Law Group in Scottsdale, Arizona. 

How has your firm worked with clients during the coronavirus, and now with the state re-openings?

We have remained open and fully operational during this time. We are available to assist current clients and are available to accept new client cases through all of the pandemic circumstances.

Arizona Courts have been changing procedures and scheduled dates rapidly. We have been keeping our clients informed continually while working with the courts on what they need to ensure our clients’ DUS cases run as smoothly as possible.

How has COVID impacted your approach to client communication?

We understood that our clients would be immediately concerned with how their DUI cases would proceed in light of state closures. To address this, each attorney on our team reached out by phone and email to all clients to touch base regarding how their cases may be affected and what they could expect next.

We encouraged meetings with clients to be done telephonically, and in-person office appointments were done on a necessary basis. Our firm also started to offer video consultations to DUI clients along with contactless document submissions by email.

As courts and other state systems return to operation, how have things changed for clients and what they need to do in your state?

Court dates have been impacted in the way that all trials were canceled during state-mandated quarantines, and many other court dates were put on hold with no suggested dates for rescheduling.

As we moved forward, more court appearances have been conducted telephonically. With these changes, it has been very important for clients to be flexible with their availability, and understanding of the fact that the changes could be sudden.

What is your recommendation to your clients on the benefits of installing an IID at this time?  

With Intoxalock continuing to install IIDs as an essential service during this time, there is no legal reason that clients cannot begin completing their compliance now. Individuals should continue to comply with all court orders during this time and continue to successfully use their IID so that they can get this part of their life behind them as fast as possible.

IIDs are generally thought of as a burden and restriction on a person’s freedom to travel. The upside of having an IID installed during these times is that many people are driving less right now due to either working from home or staying indoors. Therefore, the burden of an IID may be lessened for them because they are already driving less.

However, there are some legitimate concerns with orally using an IID given that we are living during a viral pandemic. That being said, if the necessary precautions are taken, it is safe to use your IID. For instance, do not let anyone borrow your car, breathe into your device, or touch your device. Keep your device sanitary by using provider-recommended cleaning materials to clean your device daily.
