What Happens if I Get a DUI in Oregon?

Drivers arrested on suspicion of DUI in Oregon are required to have their blood, breath, or urine tested for alcohol content. The legal limit is .08 percent blood alcohol content. Refusal to submit to a fluid or field sobriety test will result in a conviction. First-time DUI offenders in Oregon automatically have their license suspended for one year. However, installing an ignition interlock device can help drivers regain privileges despite suspension.

      First DUI Offense

Can apply for a Hardship Permit to regain driving privileges for necessary travel, and must install an IID Oregon approves.

      Second DUI Offense

License suspended for three years, but can apply for Hardship permit 90 days into suspension period, after installing an IID Oregon approves.

      Third DUI Offense

Drivers may have their license permanently revoked, but can apply for a Hardship Permit to regain driving privileges if they install an interlock device Oregon approves.

What Happens if I Fail to Complete or Refuse to Submit to a DUI Test in Oregon?

Penalties are the same for drivers who fail to complete or refuse to submit to a DUI test in Oregon.

How Do I Get a Hardship Permit in Oregon?

A hardship permit allows Oregonians to get back on the road if they install an ignition interlock device. They must also meet other criteria, including:

      • Fill out and submit a Hardship Permit Application, DMV Form 735-6044
      • Pay the $50 non-refundable application fee
      • Pay a $75 reinstatement fee
      • Obtain a recommendation from the convicting judge*
      • Submit an SR-22 Certificate of Liability for insurance
      • Install an ignition interlock device Oregon approves for the duration of the Hardship Permit period

*This is not required under Implied Consent, a law which states that if a police officer pulls a driver over for suspected DUI, the driver is deemed to have given implied consent to test their blood alcohol content.
