      The AR Ignition Interlock Program

      There are immediate penalties and many other obligations that will take time and effort to complete following the incident. Even first offenders will have their license suspended for at least six months. Some offenders may be able to obtain a modified license if they install an ignition interlock device from an approved provider.

      Ignition interlock devices are required if an offender wants to regain their driving privileges. The offender must provide proof that they have installed a state-approved interlock device before getting a modified license. This is just one of several criteria offenders must meet to get their driving privileges back.

      What Happens if I Get a DUI in Arkansas?

      Arkansas uses the terms DUI and DWI to refer to alcohol-based driving incidents, and BWI to refer to offenses where an offender is boating while intoxicated. The legal BAC limit in Arkansas is .08 percent, and any offender with a blood alcohol content at or above this limit risks a DUI conviction. These penalties may change depending on the specific circumstances of the incident.

      First DUI Offense

      • License suspended for six months
      • Must attend a Victim Impact Panel
      • Must complete a treatment program
      • 24 hours to one year in jail
      • Fines of $150-$1,000
      • Ignition interlock required

      Second DUI Offense

      • Seven days to one year of jail time (community service may be issued instead of jail time)
      • Fine of $400-$3,000
      • License suspended for 24 months
      • Must attend a Victim Impact Panel
      • Must complete a treatment program
      • SR-22 insurance now required
      • Interlock required to regain license

      Third DUI Offense

      • Fines of $900-$5,000
      • 90 days to one year in prison (community service may be issued instead of jail time)
      • Driver’s license suspended to 30 months (some offenders may be able to get a modified license after 12 months
      • Must attend a Victim Impact Panel
      • Must complete a treatment program
      • SR-22 insurance now required
      • Interlock required to regain license

      What Happens if I Refuse a BAC Test in Illinois?

      An adult who refuses to take a blood alcohol content test or chemical test may have their license suspended for up to 12 months. People caught a second time who refuse the test a second time in five years may have driving privileges revoked for three years. 

      How Do I Get a Restricted License in Illinois?

      Drivers who need a car to get to and from work, school, or other obligations may be hit especially hard by having their privileges revoked. However, Illinois has an option for these drivers called a Monitoring Device Driving Permit (MDDP), which allows them to get a restricted driver’s permit. In order to qualify, drivers must:

      • Obtain their MPPD by filling out and mailing in the application to the Secretary of State’s office
      • Wait for a reply from the Secretary of State that details any fees and will let the driver know if their application was approved
      • Once issued, drivers have to install a BAIID from an approved provider like Intoxalock within 14 days
      • If a convicted driver needs to drive their employer’s car for work, they can apply for a work exemption by providing their employer’s information

      Arkansas FAQs

      An ignition interlock device is a device that acts as a sobriety checkpoint, requiring the driver to pass a breath test before starting the car.

      Offenders convicted of drunk driving in Arkansas are sometimes required to install an ignition interlock device to regain driving privileges. The device must be from an interlock provider approved by the state. Intoxalock is an approved provider in Arkansas.

      Ignition interlock costs include installation and a monthly recurring lease costs. Arkansas customers will pay a deposit of $71.99 to $115.99, and a setup fee of $29.99. The monthly lease costs $49.99 to $115.99. Intoxalock offers flexible payment options, and customers can pay biweekly or monthly for their device.

      Once you’re ready to install the device, you can make an appointment at your preferred location. Intoxalock has several throughout the state.

      This may depend on what device you are installing. If you have a court order to install a device, you should bring the court order with the details. If you do not own the car you are having the device installed in, you will need to provide the name of the registered owner.

      The state monitoring authority should provide a list of approved providers. Intoxalock is a state-approved provider, and has nearly 100 locations throughout the state. Our state specialists can help you make an appointment if you need it. Keep in mind you will need to return on a regular basis for calibration when selecting your service center.

      You should return to your interlock provider for removal, after receiving confirmation from the state monitoring authority.

      You don’t need to provide paperwork, but you may be required to pay an account closing fee of $59.99. If you are ending the lease early, a $150 lease ending fee may apply.

      In addition to installing an ignition interlock device, some offenders may be required to pay fines, attend a Victim Impact panel, and complete an education or treatment program.

      Arkansas does not have a financial assistance program for interlock users.
